PerlineBeads SA (hereinafter "PerlineBeads" or also "the Company"), operator of the portal www.PerlineBeads.ch (hereinafter "the Website"), invites you to read the General Terms and Conditions ("GTC") carefully before placing an order.
Validity and scope of application
These terms govern the sale and delivery of products from the website www.PerlineBeads .ch (a website managed by PerlineBeads) to the customer who visits the website and/or places the order (the "customers"). Submitting the order by the customer implies acceptance of these terms and conditions. PerlineBeads may change these terms in the future by notifying the customer via a notice published on the website.
Notes
By accepting the GTC and submitting an order, the customer declares:
1. that they have read, understood and accepted the GTC in full and without reservation;
2. that they are a consumer and wish to purchase the products offered on the Website;
3. that they authorise PerlineBeads to store, process and pass on the personal data contained in the order to interested third parties in order to do so;
4. that they accept that the products received may not exactly match the details, specifications and photos on the Website.
PerlineBeads has the right to withdraw from any obligation in the event of obvious errors or inaccuracies concerning the goods or orders on the Website.
Caution: The usual process does not end positively if delivery problems are identified at the address specified for delivery. In this case, the customer will be notified to make direct contact and find an alternative way to proceed.
Orders, prices, availability and payment methods
The purchase contract between PerlineBeads and the customer is deemed concluded upon sending the order confirmation to the customer at the e-mail address provided by the customer.
In the event that a specific product in the customer's order is no longer available, PerlineBeads is not obliged to deliver the product in question, but is merely obliged to inform the customer of this circumstance without delay. If only part of the products specified in the order are available, PerlineBeads will contact the customer to ask whether they wish to cancel the order or only receive the available products. In this case, the customer will only be invoiced for the amount relating to the products they receive.
Payment is made by the customer in advance in the manner specified in the corresponding section of the website.
The prices of the products are clearly indicated on the website, expressed in CHF and include Swiss VAT. For deliveries abroad, the tax burdens of the country of destination apply. Shipping costs must be added to the price of the product. The price and availability data displayed on the website may be changed without prior notice. PerlineBeads will, however, do its best to ensure that the prices on the website are always up to date.
Shipping and delivery costs may vary depending on the country and will be invoiced to the customer at the time of dispatch of the ordered products, based on the shipping costs indicated in the corresponding section of the website. For deliveries abroad, the additional costs for any customs duties and the associated taxes are borne by the customer.
Delivery of products
The preparation and dispatch of the order take place after receipt of payment. Dispatch is carried out by Swiss Post.
PerlineBeads delivers the purchased products to the address specified at the time of ordering. Within Switzerland, delivery takes one to two working days, depending on when the order is placed.
Warranty
For all products distributed by PerlineBeads, the 24-month statutory warranty on conformity defects applies.
The customer must check the condition of the received product and, if they detect defects that make the product unsuitable for use, report the defect to PerlineBeads without delay.
To be able to claim assistance, the customer must keep the invoice and all shipping documents received with the purchased goods.
The right to a refund is subject to the following conditions, under penalty of forfeiture of the warranty:
- Before returning the defective products to PerlineBeads, the customer must obtain approval to proceed directly with the return by notifying PerlineBeads by email that they will collect the products at their own expense.
- The customer must return the goods in the original packaging and complete in all parts (including the packaging and all documents and accessories) in order to avoid damage to the original packaging. It is recommended to place them in a second box if possible. Attaching labels or adhesive tapes directly on the original packaging of the product should be avoided in any case.
- After receiving the goods and identifying the defect, PerlineBeads sends the customer an email confirming acceptance of the return.
- If PerlineBeads has the availability to forward the same product or a similar product (both in terms of style and value) with the customer's consent, PerlineBeads will replace it by forwarding a new product. Otherwise, PerlineBeads will initiate the refund procedure in favour of the customer for the price paid for the defective product. The refund of the amounts paid by the customer is always made exclusively in favour of the customer who made the payment, and in the same manner as the payment chosen by the customer.
Without prejudice to the foregoing warranty, PerlineBeads excludes any (contractual or non-contractual) liability towards the customer within the framework of the applicable mandatory provisions.
The maximum total liability limit charged to PerlineBeads may in no case exceed the amount paid by the customer for the purchase of the product.
No damages may be claimed from PerlineBeads in the event of delays in carrying out repairs or the replacement of products under the warranty.
Illegality of the AGB
Should any of these terms and conditions prove to be invalid or ineffective for any reason, the validity and effectiveness of the remaining terms and conditions shall be preserved in full.
Applicable law and competent court
These General Terms and Conditions of Sale are subject to Swiss law.
The legally binding text is in Italian.
The exclusive place of jurisdiction for disputes between PerlineBeads and the customer is Lugano.
